Article 2 Definitions
In these general terms and conditions, a number of terms occur frequently. Below are the definitions of these terms.
You (or where applicable your / your) are the natural person who is not acting for purposes related to your trade, business, craft or profession. Pottery Forms Europe enters into a distance contract with you. That is an agreement between Pottery Forms Europe and you that is concluded via the website of Pottery Forms Europe, whereby up to and including the conclusion of the agreement exclusive or joint use is made of one or more techniques for distance communication.
Technique for distance communication is a means that can be used for the conclusion of an agreement, without you and Pottery Forms Europe simultaneously in the same space to come together. The right of withdrawal means the possibility you have to waive the distance contract within the reflection period. The reflection period is the period within which you can make use of your right of withdrawal.
A durable medium is any device, including an e-mail, or message via messenger/whatsapp that enables you and Pottery Forms Europe to store information addressed to you in a way that allows future consultation or use for a period of time appropriate to the purpose for which the information is intended, and which allows unaltered reproduction of the stored information. To avoid confusion, when we refer to a day, we mean business day.
Article 3 Applicability
These general conditions apply to any offer of Pottery Forms Europe, both for the offered services, materials and / or access to digital content. Pottery Forms Europe will at all times bring these general conditions to your attention and refer to them.
Article 4 The offer
When Pottery Forms Europe makes you an offer then the digital content and / or services, as complete and accurate as possible. Pottery Forms Europe also tells you what your rights and obligations are, if you accept the offer. This enables you to make a proper evaluation and assessment of the offer.
If an offer is only valid for a certain period of time, or if there are certain conditions attached, then of course this will be mentioned in the offer. If there is a mistake or error in an offer, Pottery Forms Europe is not bound to keep the offer and has the right to withdraw and revoke the offer.
Article 5 The agreement
At the moment you accept the offer of Pottery Forms Europe and comply with the (payment) conditions attached to that offer, an agreement is established. Pottery Forms Europe will confirm this to you by email. As long as Pottery Forms Europe has not sent you a confirmation (check your spam folder) you have the right to cancel the agreement.
Please note, however, Pottery Forms Europe , within the legal framework check if you can meet your payment obligations. Pottery Forms Europe is also entitled to look at other facts and factors that are important for the responsible conclusion of the agreement, or distance contract. Should Pottery Forms Europe after this check come to the conclusion that there are justified reasons not to enter into the agreement, Pottery Forms Europe has the right to refuse an order or application or to dissolve it, as well as the right to attach special conditions to the conclusion and execution of the agreement. Of course, this decision will be communicated to you by email and you will receive the explanation of this reason / grounds. When we conclude an agreement with you, you take the goods and/or services offered.
Article 6 Right of withdrawal / return shipments
As long as the order has not been shipped yet, you can contact us by phone or email to cancel the order. After shipment, goods can only be returned with a obtained return authorization. This return authorization will only be granted if there is a valid reason for return (e.g. incorrect delivery or quality problems with the product). We expressly state that a return authorization will never be given for products sold as “seconds”, these goods are offered at a reduced price because they differ in size and/or quality.
Article 7 Prices.
All prices published and charged on our website include VAT. You will receive an official invoice by email.
Article 8 Compliance with the agreement and additional warranty
Pottery Forms Europe guarantees that it complies with the agreement, the specifications mentioned in the offer and the reasonableness and / or usability and on the date of the conclusion of the agreement legal provisions and / or labor regulations.
Article 9 Delivery and execution
Pottery Forms Europe aims to deliver the ordered goods within 5 working days. Whereby it should be expressly mentioned that this does not take into account possible delays due to overload of the package services (think of busy periods around Christmas and exceptional situations). In the unlikely event that due to unforeseen circumstances beyond the control of Pottery Forms Europe such as illness and / or family circumstances Pottery Forms Europe will not be able to fulfill the agreement, it will communicate this as soon as possible with the persons who entered into the agreement. In doing so, an alternative offer / date will initially be proposed. If an alternative agreement cannot be made, it can be said that Pottery Forms Europe remains in default and a refund will be made on the amount paid upon request.
Article 10 Digital and written information facilities.
Pottery Forms Europe will very carefully compile the content of the written and digital files. This content is of an informative nature and gives you non-binding advice. It is up to the recipient to determine how and to what extent this advice will be followed. The advice is not intended to incite any compelling action or omission. The achievement of an intended result as a result of this digital content and instructions can therefore not be guaranteed.
Article 11 Payment
Goods ordered through Pottery Forms Europe must be paid in full in advance. This will be done through the selection menu of the web store of our site. Per payment an invoice will be issued, which will be sent to you by e-mail. The amounts listed on the site include VAT. You are obliged to immediately report inaccuracies in payment information provided or mentioned to Pottery Forms Europe.
Article 12 Complaints
Pottery Forms Europe makes every effort to keep the quality of goods and services high. In the unlikely event that you have a complaint about the materials received and/or the execution of the agreement, you can file a complaint. Submitting a complaint can only be done in writing by e-mail within a reasonable period after the goods and/or services have been received (as a guideline, consider a period of 5 working days after receipt of the goods - slightly longer during the vacation period). When submitting the complaint, please include your invoice number and the item number the complaint is about, further we request that you describe the complaint as completely as possible and include pictures so we can get a clear picture. It is possible that after receiving the complaint you will receive an email to provide additional information. If there are any questions, please return these questions completed as completely as possible so that we can form a clear picture of the nature and origin of the complaint. After evaluation of the complaint, Pottery Forms Europe will try to resolve the complaint by mutual agreement as soon as possible, but at the latest within 4 weeks. If after the 4 week period it is not an agreement, there is a dispute. For all Pottery Form products a description will be included for the maintenance and storage of the products. Complaints about the quality of the products related to improper handling and / or storage of the products can never lead to compensation and / or return of these products.
Article 13 Dispute
On agreements between you and Pottery Forms Europe to which these general conditions apply, only Dutch law is applicable. The Law determines which court is competent to take cognizance of the dispute.
